These terms and conditions (“ Terms ”) govern the use of services made available on or through  https://www.gotathome.com  and/or the GotAtHome mobile app (collectively, the “ Platform ”, and together with the services made available on or through the Platform, the “ Services ”). These Terms also include our privacy policy, available at https://www.gotathome.com/privacy.html (“ Privacy Policy ”), and any guidelines, additional, or supplemental terms, policies, and disclaimers made available or issued by us from time to time.

 

  1. By using the Services, you agree that you have read, understood, and are bound by, these Terms, as amended from time to time, and that you will comply with the requirements listed here. These Terms expressly supersede any prior written agreements with you. If you do not agree to these Terms, or comply with the requirements listed here, please do not use the Services.

 

(a)            Our Services offer a Platform that helps you organize and schedule a range of home-based services with independent third-party providers, known as Service Professionals. As part of these Services, GotAtHome manages the payment process by handling and transferring funds to Service Professionals for the services they deliver, and collects payments on their behalf.

 

(b)            GotAtHome connects users with Service Professionals, who offer what are called "Pro Services." It's important to note that these Pro Services are separate from the general services offered on the platform. GotAtHome itself doesn’t provide or take responsibility for these Pro Services. The Service Professionals are fully responsible for the services they offer. To be clear, Service Professionals aren’t employees, agents, or partners of GotAtHome, and they don’t have the authority to act on behalf of the company. GotAtHome simply serves as a platform for these independent professionals to offer their services.

 

(c)             The Platform is meant for your personal, non-commercial use, unless you've made a different arrangement through a separate agreement. Also, it's important to know that the Platform is designed specifically for use within India. If you use the Services or Pro Services from a location outside of India, you'll be considered to have accepted the terms and conditions that apply to that specific region.

 

(d)            The Services are made available under various brands owned by or otherwise licensed to GotAtHome and its affiliates.

 

(e)            A key part of the Services is GotAtHome’s ability to send you text messages, emails, or WhatsApp messages about your bookings, service usage, or as part of promotions and marketing. You can opt out of these messages by contacting GotAtHome at  privacy@gotathome.com  or adjusting your settings within the Platform. Just keep in mind that opting out might impact GotAtHome’s ability to fully provide certain Services to you.

 

(f)              In some cases, you may need to provide identification proof to access the Services or Pro Services, and by using the Platform, you agree to do so. If you fail to provide the requested identification, you may be unable to use the Services or Pro Services.

(a)            Create an account to access our services. Registration requires a minimum age of 18 and may include providing your phone number.

 

(b)            Keep your Account information accurate and current. Update your details promptly if changes occur.

 

(c)             Secure your Account. Report any unauthorized access or security breaches to us immediately.

 

(d)            You're responsible for all activity on your Account, even if someone else uses it. We're not liable for unauthorized access.

 

(e)            You agree to receive communications from us regarding payments, updates, promotions, and service-related matters.

(a)            Our Platform allows registered users to share content, such as comments, reviews, and feedback ('User Content')

 

(b)            We may ask for reviews about Service Professionals, who can also review you. Please provide honest and accurate feedback. Reviews help us ensure quality and determine user suitability. We may cancel your registration if we deem you an inappropriate user.

 

(c)             You grant us a non-exclusive license to: - Use, publish, and distribute User Content for Service operation - Use User Content for advertising and promotion - Provide evidence in court, if necessary

 

(d)            You waive all moral rights and similar claims related to User Content under these Terms.

 

(e)            GotAtHome reserves the right to remove or restrict User Content that violates these Terms, without notifying you.

(a)            We collect and use your personal data as described in our Privacy Policy: https://www.gotathome.com/privacy.html

 

(b)            You agree we may share your information with affiliates and service providers. We use Service usage data for: - Service improvement - Analytics - Statistics - New offers - Enhancing your experience"

 

(c)             We may share your data with law enforcement or government agencies if required by law, for criminal or civil investigations. You agree to such disclosure.

(a)            Orders : Book Pro Services on the Platform at a time that suits you. Follow these steps: 1. Choose your service. 2. Select a timeslot. 3. Provide necessary details. We'll find a Service Professional for your requested time. If unavailable, we'll suggest alternatives

 

(b)            Confirmation : Bookings follow these steps: 1. Request a service. 2. Receive booking confirmation (SMS, email, or push notification). 3. Make payment as instructed. 4. Receive Service Professional assignment confirmation (in-app, SMS, email, or push notification).

 

(c)             Cancellations :- No charge for bookings cancelled before Platform confirmation. - See our cancellation policy for applicable fees

 

(d)            Substitution : If your selected Service Professional cancels or is unavailable, we'll offer a replacement from our registered professionals.

(a)            We reserve the right to charge for Services and facilities on the Platform, with prices subject to change.

 

(b)            Charges and Fees in respect of Pro Services :

 

(i)              Payment Breakdown: 1. Service Professional Charges: - Booked service amount - Additional services - Out-of-pocket expenses - Materials purchased 2. GotAtHome Fees: - Convenience fee for booking and payment processing 3. Additional Charges (as applicable): - Safety fee - Warranty fee - Insurance fee - Service Professional welfare fee By using our Platform, you acknowledge and agree to these payment terms.

 

(ii)            GotAtHome will notify you of applicable Charges, Fees, and payment methods at booking. Accepted payment methods include: - Credit/debit cards - Net banking - Wallets - UPI - Cash upon completion (subject to availability) We reserve the right to modify or restrict payment methods. Please note: - Cash upon completion may not always be available. - When using cash upon completion, you must pay both Charges and Fees to the Service Professional."

 

(iii)           The Charges and Fees may be payable either at the time of booking or upon completion of the Pro Service, as specified by GotAtHome.

 

(iv)           For clarity, please note that the Charges are payable to the Service Professionals, and GotAtHome acts as a limited collection agent on their behalf to collect and transfer the amounts due.

 

(v)            Taxes : All Charges and Fees are inclusive of applicable taxes.

 

(vi)           GotAtHome may amend the Charges and Fees at its discretion. Any adjustments to the Fees will not affect bookings that were confirmed prior to the publication of the revised Fees on the Platform.

 

(vii)         Charges and Fees are final and non-refundable, except as determined by GotAtHome or as required by applicable laws. In certain cases, you may be entitled to a refund or other remedies if there is a failure in the provision of the Services, as dictated by those laws.

All The Eligible Refunds will be Processed Within T+2 Days.

 

 

(viii)       You acknowledge and agree that Charges and Fees may rise significantly in certain areas during periods of high demand. GotAtHome will make reasonable efforts to notify you of applicable Charges and Fees. Nonetheless, by using the Pro Services or Services, you are responsible for all Charges and Fees incurred under your Account, even if you are not aware of these Charges or Fees.

 

(c)             Payment Processors : We may use a third-party payment processor to bill you through your chosen payment method. The processing of payments will be governed by the terms and policies of the Payment Processor, in addition to these Terms. We are not liable for any errors made by the Payment Processor. If a payment is unsuccessful, any debited funds will be refunded according to the Payment Processor’s terms.

 

(d)            Cancellation : You may choose to cancel your request for services from a Service Professional at any time before their arrival. In such cases, you may incur a cancellation fee in accordance with GotAtHome’s cancellation policy. GotAtHome reserves the right to charge you or deduct applicable taxes related to the cancellation fee.

 

(e)            Subscriptions : GotAtHome may periodically offer subscription packages (under any name) for a fee. These packages provide Customers with additional benefits, such as access to discounted Pro Services. You agree that subscription packages will be subject to additional terms and conditions. These terms and conditions will be considered an integral part of these Terms.

 

(f)              GotAtHome does not allocate any part of your payment as a tip or gratuity for the Service Professional. Any communication from GotAtHome indicating that tipping is “voluntary,” “not required,” or “included” in your payments does not imply that GotAtHome provides additional compensation to Service Professionals. You understand and agree that you may offer a gratuity to any Service Professional who provides you with Pro Services, but you are under no obligation to do so. Gratuities are completely voluntary.

(a)            GotAtHome prohibits discrimination against Service Professionals based on race, religion, caste, national origin, disability, sexual orientation, sex, marital status, gender identity, age, or any other characteristic protected by applicable law. This prohibition includes, but is not limited to, refusing to accept Pro Services due to any of these characteristics.

 

(b)            We ask that you treat all Service Professionals with courtesy and respect, and provide them with a safe, clean, and suitable environment to perform the Pro Services. Service Professionals have the right to refuse to perform Pro Services if you do not provide a safe and appropriate location or if you behave in a manner that is discourteous, disrespectful, abusive, or otherwise inappropriate. We reserve the right to deny access to the Services and limit your access to Pro Services at our sole discretion if you act towards any Service Professional in a manner that we consider discourteous, disrespectful, abusive, or otherwise inappropriate or unlawful.

 

(c)             You agree to be liable for any discrimination against Service Professionals or for any failure, whether intentional or otherwise, to provide them with a safe, clean, and suitable location to perform the Pro Services. Additionally, you are required to disclose any information that could affect the Service Professional's ability to perform the Pro Services or impact their health, safety, or well-being, to GotAtHome and the Service Professional.

 

(d)            You agree that if a Service Professional behaves in a manner that is discourteous, disrespectful, abusive, inappropriate, or in violation of the law, you must report the incident to  grievance@gotathome.com  as soon as possible, and in any case, within 48 hours of the incident.

(a)            The Platform may feature services, content, documents, and information that are owned by, licensed to, or otherwise made available by third parties, and may include links to Third Party Services. You understand and acknowledge that Third Party Services are the sole responsibility of the third party that created or provided them, and that using such Third Party Services is at your own risk.

 

(b)            We make no representations and exclude all warranties and liabilities arising out of or pertaining to such Third Party Services, including their accuracy or completeness. Should you avail a Third Party Service, you shall be governed and bound by the terms and conditions and privacy policy of the third parties providing the Third Party Services. Further, all intellectual property rights in and to Third Party Services are the property of the respective third parties.

(a)            You represent and warrant that all information you provide in connection with the Services and Pro Services is complete, true, and accurate as of the date you agree to these Terms and will remain so while you use the Services and/or Pro Services. If any of the information changes during the term of these Terms, you agree to notify us immediately. We are not responsible or liable for any loss or damage you may suffer if the information, documentation, materials, or data you provide are incorrect, incomplete, inaccurate, or misleading, or if you fail to disclose any material facts.

 

(b)            You shall extend all cooperation to us in our defence of any proceedings that may be initiated against us due to a breach of your obligations or covenants under these Terms.

 

(c)             In respect of the User Content, you represent and warrant that:

 

 

(i)              you own all intellectual property rights (or have obtained all necessary permissions) to provide User Content and to grant the licences under these Terms;

 

(ii)            you are solely responsible for all activities that occur on or through your account on the Platform and all User Content;

 

(iii)           the User Content does not and shall not violate any of your obligations or responsibilities under other agreements;

 

(iv)           the User Content does not and shall not violate, infringe, or misappropriate any intellectual property right or other proprietary right including the right of publicity or privacy of any person or entity;

 

(v)            the User Content does not and shall not contain any viruses, corrupted data, or other harmful, disruptive, or destructive files or content;

 

(vi)           the User Content does not and shall not violate any third party rights; and

 

(vii)         The User Content (A) does not infringe on the rights of any other person, (B) does not threaten the unity, integrity, defense, security, or sovereignty of India, damage friendly relations with foreign states, disturb public order, incite the commission of any cognizable offense, obstruct the investigation of any offense, or insult any nation, (C) is not defamatory, grossly harmful, blasphemous, pedophilic, invasive of privacy, discriminatory based on gender, ethnically objectionable, disparaging, related to or encouraging money laundering or gambling, libelous, hateful, racist, violent, obscene, pornographic, unlawful, harmful to children, or (D) otherwise offensive, objectionable, or restricting or inhibiting others from using or enjoying the Services.

 

(d)            You are only permitted to use the Services as explicitly allowed in these Terms. Without limiting the scope of this restriction, you shall not:

 

(i)              violate any proprietary rights, including but not limited to copyrights, patents, trademarks, or trade secrets of any party;

 

(ii)            except as expressly allowed under these Terms, copy, display, distribute, modify, publish, reproduce, store, transmit, post, translate, create derivative works from, or license the Services;

 

(iii)           use the Services to transmit data, or send or upload any material that contains viruses, Trojan horses, worms, timebombs, keystroke loggers, spyware, adware, or any other harmful programs or similar computer code designed to negatively impact the operation of any computer software or hardware;

 

(iv)           use any robot, spider, automated device, or manual process to monitor or copy the Services or any part of it;

 

(v)            engage in the systematic retrieval of content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory;

 

(vi)           use the Services in (A) any unlawful manner, (B) for fraudulent or malicious activities or (C) in any manner inconsistent with these Terms;

 

(vii)         decompile, reverse engineer, or disassemble the Services;

 

(viii)       link to, mirror, or frame, any portion of all or any of the Services; or

 

(ix)           violate applicable laws in any manner.

 

(e)            You warrant that you shall not engage in any activity that interferes with or disrupts the Services.

 

(f)              You shall not attempt to gain unauthorised access to any portion or feature of the Services, any other systems or networks connected to the Services, to any of our servers, or through the Platform by hacking, password mining, or any other illegitimate means.

 

(g)            You agree not to directly or indirectly solicit, influence, engage, or approach a Service Professional from whom you have received Pro Services, with the intent of having them terminate their registration on or engagement with the Platform, or to provide similar services independently without using your Account. You acknowledge that this restriction is reasonable and necessary to protect the privacy and security of Service Professionals and does not prevent you from obtaining similar services through the Platform or other means. You further agree that the potential harm to Service Professionals from not enforcing this clause outweighs any potential harm to you.

(a)            All rights, titles, and interests in the Services, including all intellectual property rights associated with the Services, are owned by or licensed to us. Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited license to use the Services in accordance with these Terms and our written instructions provided from time to time. Any rights not expressly granted here are reserved by GotAtHome or its licensors.

 

(b)            We may ask you to provide suggestions and feedback, including bug reports, regarding the Services from time to time (“Feedback”). We are free to use, copy, disclose, publish, display, distribute, and exploit any Feedback we receive from you without paying royalties, providing acknowledgment, obtaining prior consent, or facing any other restrictions related to your intellectual property rights.

 

(c)             Except as expressly stated in these Terms, nothing in these Terms should be interpreted as granting any rights to, or licenses for, our or any third party's intellectual property rights.

(a)            These Terms shall remain in effect unless terminated in accordance with the terms hereunder.

 

(b)            We may restrict, deactivate, or terminate your access to, or use of, the Services, or any part of them, (i) immediately and at our sole discretion if (A) you violate any obligations or responsibilities under these Terms, (B) you cease to be a user of our Services, (C) you do not, or are unlikely to, qualify under applicable law or the standards and policies of GotAtHome or its affiliates, or (D) you breach the Community Guidelines, (ii) with 30 days’ prior written notice, or (iii) immediately for any legitimate business, legal, or regulatory reason.

 

(c)             You may terminate these Terms, at any time, for any reason by sending a notice to UC at privacy@gotathome.com

 

(d)            Upon termination of these Terms:

 

(i)              the Account will expire;

 

(ii)            the Services will “time-out”; and

 

(iii)           these Terms shall terminate, except for those clauses that are expressly, or by implication, intended to survive termination or expiry.

 

(a)            The Services are provided on an "as is" basis, without any warranties of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of title, non-infringement, merchantability, or fitness for a particular purpose. We do not guarantee that the Services will meet your requirements or expectations.

 

(b)            No advice or information, whether oral or written, obtained from us shall create any warranty that is not expressly stated in these Terms.

 

(c)             While GotAtHome strives to provide accurate information about Pro Services and Charges, pricing errors may occasionally occur.

 

(d)            You agree and acknowledge that we are solely a Platform that connects you with Service Professionals, and we are not liable for any obligations not expressly stated in these Terms. We are not responsible for booking fulfillment, the performance of Pro Services by Service Professionals, or any acts or omissions of Service Professionals during their service, including any property damage they may cause. By booking Pro Services through the Platform, you enter into a contract directly with the Service Professional for those services. We accept no responsibility or liability, and we make no warranty, representation, or guarantee regarding the Service Professional’s performance under that contract.

 

(e)            You agree and acknowledge that soliciting or receiving services from any Service Professional independently is at your own risk. In such cases, you waive any rights you may have under these Terms.

 

(f)              We do not guarantee, warrant, or make any representations regarding the reliability, quality, or suitability of the Service Professionals.

 

(g)            You accept full responsibility for any consequences arising from your use of the Services and Pro Services and expressly agree and acknowledge that we shall have no liability in this regard.

 

(h)            GotAtHome will maintain and manage a complaints management framework on behalf of Service Professionals in a reasonable manner, adhering to the non-excludable requirements of relevant applicable laws.

 

(i)              To the fullest extent permitted by law, we, our affiliates, and our related parties disclaim all liability for any loss or damage arising from or related to:

 

(i)              your use of, inability to use, or availability or unavailability of the Services or the Pro Services;

 

(ii)            any defects, interruptions, or delays in the operation or transmission of information to, from, or through the Services, communication failures, theft, destruction, or unauthorized access to our records, programs, services, servers, or other infrastructure related to the Services;

 

(iii)           the failure of the Services to remain operational for any period of time; and

 

(iv)           the loss of any User Content and any other data in connection with your use of the Services.

 

(j)              Under no circumstances shall GotAtHome, its officers, directors, employees, contractors, agents, licensors, partners, or suppliers be liable to you for any direct, special, indirect, incidental, consequential, punitive, reliance, or exemplary damages. This includes, but is not limited to, lost business opportunities, lost revenues, loss of anticipated profits, or any other pecuniary or non-pecuniary loss or damage of any kind, including abuse or breach of data, even if GotAtHome or an authorized representative had been advised of the possibility of such damages. This limitation of liability applies to damages arising from or related to (A) these Terms, (B) the Services or Pro Services, (C) your use or inability to use the Services or Pro Services, or (D) any interactions with other users of the Services.

 

(k)            To the fullest extent permitted by law, our liability will be limited to the amount of commission we receive for a particular booking made on the Platform. Under no circumstances shall our total liability to you in connection with these Terms exceed INR 10,000 (Rupees Ten Thousand).

 

(l)              Nothing in these Terms will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit.

You agree to indemnify, defend (at our option), and hold GotAtHome, its parent companies, subsidiaries, affiliates, and its officers, employees, directors, agents, and representatives harmless from any claims, demands, lawsuits, legal proceedings, losses, liabilities, damages, and costs (including, but not limited to, damages, liabilities, settlements, and attorneys' fees) arising from or related to your access to or use of the Services or Pro Services, any breach of these Terms by you, or any breach of these Terms by a third party using your Account. 

(a)            These Terms shall be governed by and construed in accordance with the laws of India. Subject to other provisions in this clause, the courts in New Delhi shall have exclusive jurisdiction over any disputes arising from these Terms or the use of the Services.

 

(b)            Any disputes, conflicts, or differences arising from these Terms shall be resolved through arbitration in New Delhi, in accordance with the Arbitration and Conciliation Act, 1996, which is deemed incorporated by reference into this clause. The arbitration tribunal will consist of a single arbitrator appointed by GotAtHome. The arbitration proceedings will be conducted in English and will be kept confidential, with disclosures only made on a need-to-know basis or to legal advisors, unless required by law. The arbitrator's decision will be final and binding on all parties. Each party will bear its own costs related to the arbitration.

(a)            You may contact our designated Grievance Redressal Officer with any complaints or queries relating to the Services or these Terms through registered post or through email, details of which are provided below:

(b)            We shall ensure that your complaint is resolved within timelines prescribed by applicable laws.

(a)            Changes to Terms : We may revise these Terms at any time at our discretion, with changes becoming effective immediately upon posting on the Platform. It is your responsibility to review these Terms regularly for any updates. Your continued use of the Platform after changes are posted will be deemed acceptance of the revised Terms.

 

(b)            Modification to the Services : We reserve the right to add, modify, or discontinue the Services (or any part thereof) at any time, whether temporarily or permanently, with or without cause. We shall not be liable for any such addition, modification, suspension, or discontinuation of the Services.

 

(c)             Severability : If any provision of these Terms is deemed unlawful or unenforceable by a court or other competent authority, the remaining provisions will remain in full force and effect. If a provision is unlawful or unenforceable but could be made lawful or enforceable by removing part of it, that part will be removed, and the rest of the provision will continue to apply. If this approach would contradict the clear intention of the provision, then the entire provision will be considered deleted.

 

(d)            Assignment : You may not license, sell, transfer, or assign your rights, obligations, or covenants under these Terms, or your Account, without our prior written consent. We may grant or withhold this consent at our sole discretion and may impose any conditions we consider appropriate. We may assign our rights to any of our affiliates, subsidiaries, parent companies, successors in interest of any business related to the Services, or any third party without prior notice to you.

 

(e)            Notices : All notices, requests, demands, and determinations for us under these Terms (other than routine operational communications) shall be sent to legal@gotathome.com.

 

(f)              Third Party Rights : No third party shall have any rights to enforce any terms contained herein.

 

(g)            Force Majeure : We shall not be liable to you for any failure or delay in performing our obligations or conducting our business due to acts, events, omissions, or accidents beyond our reasonable control. This includes, but is not limited to, strikes, utility service or telecommunications network failures, acts of God, war, riots, civil commotion, malicious damage, or compliance with any law, governmental order, rule, regulation, or directive.
